London Arbitration Week 2025

As part of London Arbitration Week, CJC and 36 Stone held an expert-led session to take a closer look at key aspects of the Arbitration Act 2025.

On 1 August 2025, the Arbitration Act 2025 came into force, introducing several new sections within the Arbitration Act 1996. Although the 1996 Act has not undergone a complete reform, these new sections are set to influence the practice of maritime arbitration in London, including arbitrations conducted under LMAA terms. As such, there were short talks given on the following new Arbitration Act provisions:

s. 6A: law of the arbitration agreement, presented by David Owens, Director, CJC

s. 23A: impartiality and duty of disclosure for arbitrators, presented by Richard Hickey, Managing Associate, CJC

s. 41A: emergency arbitrators, presented by Bethany Smith, Barrister, 36 Stone

s. 39A: power to make award on a summary basis, presented by Professor Charles Debattista, Barrister, 36 Stone

The session was chaired by Sir Jeremy Cooke, arbitrator and former Judge in charge of the Commercial Court.
